Welcome to Sweet Skin’s (“Sweet Skin”, “we” or “us”) website (collectively, the “Site”). Access to and use of the Site and related services (collectively, the “Services”) are made available to you in accordance with the following Terms of Service and any other rules and policies posted on the Site, including the Privacy Policy (collectively, the “Terms Of Service” or “TOS”). By using the Services, such as browsing or placing orders on the Site, you are agreeing to all of the Terms of Service.

We will collect, use and store any personal data provided by you in accordance with the Privacy Policy.

Sweet Skin reserves the right to make changes to the Site or any part of the TOS at any time. Please visit this page from time to time to check for any updates or changes to any part of the TOS (including the said rules and policies and the Privacy Policy).

SALES AND PURCHASE

• ● All orders of Products/ Services placed shall be subject to acceptance by Sweet Skin.
• ● After you place order, we will send you an email to acknowledge the receipt of your order request. This email is only a confirmation of receipt of your order request and does not constitute an acceptance of you order.
• ● Sweet Skin will only accept orders of Products/ Services from a Customer who are attained the age of 18 years.
• ● In registering an account and in your use of the Site, you agree to (where necessary) provide information about yourself (email address, real name, phone number, billing information and other requested information as indicated on the Site) that is true, accurate, current, and complete in all respects. Please refer to our Privacy Policy for more information on how we use your personal data.
• ● In using the Site, you are responsible for safeguarding the password of your account and all use of our Services under your account. Please take reasonable care in protecting access to your account from any unauthorized use. If you suspect that the security of your account has been compromised or if there is unauthorized use of your account, please contact us immediately.
• ● Your order will be accepted and the contract between you and Sweet Skin will be completed when we send you an email to confirm the goods have been dispatched to you and your payment has been accepted. Only the goods listed in the confirmation email sent at the time of dispatch are subject of the sale contract.
• ● All Products are subject to stock availability.
• ● In placing an order with us, you authorize Sweet Skin to process a charge or charges on your credit card in the amount of the total purchase price of your order. You also expressly authorize us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including, but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information.
• ● The Site is for your personal use only. You may not purchase goods from the Site for reselling purposes or commercial exploitation.
• ● Sweet Skin reserves its right not to accept an order for any reason in its sole discretion.

PRICING AND PAYMENT

• Prices displayed on the Site at the time your order is accepted will be honored except in the case of obvious error.
• If your credit card is not denominated in Hong Kong Dollars (HKD) or US Dollars (USD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.
• We accept payments made by credit cards only. And we use Strip as our payment gateway. If Strip refuses to authorize payment to Sweet Skin, we will not be liable for any delay or non-delivery.
• For any subcharge or exchange rate difference due to refund or paymnet cancelation. We do not assume any responsibility for any loss, Sweet Skin does not pay any compensation.

SHIPPING AND COLLECTIONS

• We endeavour to dispatch all products ordered in 5 working days after the order has been accepted by us and all the payment is made successfully.
• Customer is responsible for all shipping charges involved, applicable customs and import duties, fees, taxes, and any other charges that may incur. Customer may inquire your local custom office for more details.
• Sweet Skin shall not liable for any delay or failure in delivering the Products caused by or resulting from accidents, traffic conditions, weather conditions or any other causes beyond the control of Sweet Skin.
• You need to sign a confirmation of receipt of the products when the products are collected and by doing so, you accept the Products being in good condition and the responsibility for the Products ordered from that moment on.
• Generally speaking, since the goods being shipped are owned by the shipper or consignee, customs officers will only open Your package under certain circumstances. These circumstances include, but are not limited to, random inspections conducted by customs officers for detecting, preventing and investigating any illegal activities.

EXCHANGE/REFUND OF PRODUCT

• Exchange/Refund requests due to specification issue of the Product must be made within 24 hours after receiving the Products and provided that:

the Product must not be opened or used;

all parts, accessories, warranties, free gifts, redeemed items are intact and returned together with the Product;

the original invoice and the credit card used to purchase the Product must be presented;

• No exchange will be accepted for personal grooming products with no quality problems.
• Warranty period is subject to manufacturer’s or vendor’s policy. During the warranty period, you may return the products to the manufacturer or vendor for repair. Warranty does not cover the damage caused by accident, negligence, misuse, improper operation and modifications of Product.
• No exchange or return will be accepted for all skincare and cosmetics products.
• All shipping, taxes and duties will not be refunded.
• All the exchange/refund of Products will be subject to additional shipping charges.

FORCE MAJEURE

• Sweet Skin shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labor difficulties, equipment failures, or any other causes beyond the control of Sweet Skin.

DISCLAIMER

• Sweet Skin does not guarantee that the use of the Site and Services will be error-free or that the Site or the servers that make it available are free of viruses or other harmful components. Your use of the Site is at your risk. We recommend all users of the Site to ensure they have up-to-date software, including anti-virus, installed.
• We will endeavour to ensure that the Content and the product descriptions on the Site are as accurate and complete as possible. We however do not warrant that “Content” and product descriptions are accurate, complete, current or error-free. Sweet Skin disclaims any liability or responsibility for any errors or omissions in the content on the Site. Neither Sweet Skin nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or inability to use or access, the Site.
• Sweet Skin reserves the right to withdraw or amend any item of the Services without notice. We will not be liable if for any reason the Site is unavailable at any time and for any period.
• Sweet Skin is not responsible for the content of any site linked to or from the Site. Your linking to any other site is entirely at your own risk. While Sweet Skin may provide links on this Site to other sites, the inclusion of such links is for your convenience only and should not be interpreted as an endorsement of the owner/sponsor of the site or the content of the site. Sweet Skin disclaims all warranties, express and implied, as to the accuracy, validity, legality or otherwise of any materials or information contained on such sites.
• Although Sweet Skin may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards and the like on the Site, Sweet Skin is under no obligation to do so and assumes no responsibility or liability arising from the contents of any such communications nor for any error, defamation, libel, obscenity, profanity, or inaccuracy contained in any such communication. You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libelous, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law. • Materials displayed on the Site are either the property of, or used with permission by, Sweet Skin. The use of these materials by you, or anyone else authorized by you, is prohibited. Any such action establishes liability for a civil action.

INTELLECTUAL PROPERTY

• All software and “Content” (which is defined as, or includes, any text, audio or music, video, graphics, photographs, and image) are the intellectual property of Sweet Skin and are protected by intellectual property and copyright laws and international treaty provisions.
• The Site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the Content is only permitted when expressly authorized by Sweet Skin and/or its third party licensors. You may not distribute, reproduce, publish, sell or license any Content contained within the Site without prior consent or authorization of Sweet Skin. Any such unauthorized actions may result in civil consequences or criminal penalties.

GOVERNING LAW AND JURISDICTION

• The TOS, together with all our policies and procedures, are governed by and construed in accordance with Hong Kong SAR law. The relevant courts of Hong Kong SAR will have exclusive jurisdiction in the event of any dispute or claim associated with these TOS.
